Digital Millennium Copyright Act (DMCA) Compliance

Oktoberfest 2024 respects the intellectual property rights of others and expects its users to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA).

Filing a DMCA Complaint

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on this site, please notify us by providing the following information to our designated DMCA agent at admin@oktoberfest2024.us:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed.
  2. Identification of the infringing material: A description of where the material that you claim is infringing is located on the site, including a URL or other specific location.
  3. Your contact information: Your address, telephone number, and email address.
  4. A statement of good faith belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement of accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Your electronic or physical signature: An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.

Counter-Notification

If you believe that your content was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by providing the following information to our designated DMCA agent at admin@oktoberfest2024.us:

  1. Identification of the removed material: A description of the material that was removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  2. Your contact information: Your address, telephone number, and email address.
  3. A statement of good faith belief: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. A statement of consent: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Oktoberfest 2024 may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  5. Your electronic or physical signature: Your electronic or physical signature.

Upon receipt of a valid counter-notification, we may restore the removed content in accordance with the DMCA.

Repeat Infringers

In accordance with the DMCA and other applicable law, Oktoberfest 2024 has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
